Updates to the Employee Eligibility Verification Form

Employers who work with non-U.S. employees need to be aware of the publication of an updated version of the I-9 Form. Known officially as the Employment Eligibility Verification form, the I-9 is used to verify the identify and employment authorization of new hires by U.S. employers.

The updated form can be identified by an edition date of Jan. 20, 2025, and an expiration date of May 31, 2027. What might be confusing is that other versions of the I-9 form remain valid, but legal providers encourage U.S. employers to remove prior paper and electronic versions and to start using the new form immediately.

Most Recent I-9 Form Updates

  • Renaming the fourth checkbox in Section 1 to “An alien authorized to work.”
  • Revising the descriptions of two List B documents in the List of Acceptable Documents (driver’s license or ID card), removing the word ‘gender’ and replacing it with the word ‘sex.’

The updated form is available on the United States Citizenship and Immigration Services website. Employers must also update their electronic systems with the I-9 form with May 31, 2027, expiration date by July 31, 2026.
